The regime of Turkmenistan commits many crimes against the people of Turkmenistan, against world heritage and against human rights. We have some worries that we would like you to look in to. We have some worries about the French company ”Bouygues” and their Turkmenistan-division.

We have some information about one building project in a village called “Kipchak”, not far from the capital Asgabad during the months june and july 2003. During the construction work of a mosque called “Spiritual” an old turkmanian graveyard was destroyed, it was built for burials during the stone age.

The company responsible for the construction work was the French company “Bouygues”, and the company management concealed that the graveyard was found. This can only be looked at as a crime against world heritage. The people in Turkmenistan does not have the possibility according to the law to defend our heritage and that is why we beg of you, The French government to please make sure that the company is held responsible for the damaged they has caused.

This construction company has broken the UN declaration that the people in a country has the right to preserve and protect its fortune, culture and ceremonial objects.

Since the people of Turkmenistan can not use the UN declaration in its country the international right looses its function in Turkmenistan.

President Saparmurad Nijasov has, without consideration to the people, allowed the French company to bee in Turkmenistan and let their action bee unpunished.

We would also like you to look into the “gift” that Bouygues built in honour to President Nijasov. They built an mausoleum for his family and placed it next to the mosque “Spiritual”.

The president confirmed this on a government conference that was aired on national television. The president said on this meeting that the company was building this mausoleum as a present to the president of the neutral Turkmenistan. That was an insulting treatment to all of us who are not allowed to practise our human rights because of the president in Turkmenistan.

This present that Bouygues has built in honour of the president must sees as a bribe, because Bouygues was given new orders for hundreds million dollars after this present.

We can also not rule out that this payment is not a way for the Turkmanian government to laundry money that they have received as payment for selling gas to Russia and to Europe.

The president said on another TV-aired government conference that he alone pays for the orders, cash and not trough any bank.
But on the government meeting march first 2006 the president said that Bouygues, who has become the major construction company in Turkmenistan, has been paid trough a special committee.

This action from the French construction company Bouygues is a direct insult to us that tries to achieve human rights for all the people in Turkmenistan. This is not only a violation against the Turkmanian law but also against international rights.

The French government is not responsible for the action of the French construction company. But that you have a possibility to help the Turkmanian people and to let the company be punished for their actions in Turkmenistan

The Turkmen opposition in exile considers the self-proclaimed Turkmen President for life Niyazov illegitimate, based on the breaches of law during his first election and rigged re-elections that followed. Since holding free elections in Turkmenistan for the time being remains impossible, this could mean the lack of any legitimate power. Yet the Turkmen opposition in exile has analysed the history of 1989- 1990ies and came to the conclusion that de jure the Supreme Council of the Soviet Republic of Turkmenistan has never been dissolved.

De facto the working of the Supreme Council has been terminated by the illegitimate actions of Niyazov in May 1992. However, the Chairman of the Supreme Council has not ratified the Constitution on the basis of which Niyazov is claiming his authority, as it was foreseen by the law at that time, respectively, Niyazov” s Constitution legally has never entered in force.

The Supreme Court has never taken a decision about own dissolution, which was the legitimate way to the new elections foreseen by the law in force at that time.

According to the Constitution of 1989- 1990, which is de jure still in force in Turkmenistan, the Chairing Committee of the Supreme Council holds its authority until the newly elected Supreme Council of Turkmenistan takes over.

According to the details mentioned above and the number of other legal arguments, the Chairing Committee of the Supreme Council of Turkmenistan considers itself to be the only legitimate government of Turkmenistan at this time and continues its workings in exile until there will be a possibility to form a caretaker government in the country and call for the new elections.

Obviously, the goal is not to restore the Soviet Republic of Turkmenistan as such, but to preserve the legitimate government, elected in the brief moment when Gorbachev”s reforms allowed for free elections. The ultimate goal would be to smooth the transition from the inevitable breakdown of Niyazov”s regime to the new free elections by the existence of caretaker government, elected by the people of Turkmenistan and thus enjoying respective legitimacy.
